By accessing or using the Caplo application ("Service"), provided by Sparklight AI, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service. We reserve the right to update or modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
Caplo is a real-time audio transcription and translation application for iOS. The Service captures audio through iOS Screen Broadcast (system audio) or microphone input, provides real-time speech-to-text transcription, and offers translation into up to 12 languages. Captions can be displayed in a Picture-in-Picture overlay on top of other applications. Session records are stored locally on your device and can be synced via iCloud.
Subject to your compliance with these Terms, Sparklight AI grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal purposes. You may not: (a) reproduce, distribute, or create derivative works based on the Service; (b) reverse engineer, decompile, or disassemble any part of the Service; (c) use the Service for any unlawful purpose or in violation of any applicable laws; (d) sublicense, sell, or otherwise transfer your rights to use the Service to any third party.
You retain ownership of all audio content you capture and all transcriptions and translations generated through the Service. You are solely responsible for ensuring that your use of the Service complies with applicable laws, including any laws related to recording audio or conversations in your jurisdiction. Some jurisdictions require consent from all parties before recording. Sparklight AI is not responsible for any unauthorized recording conducted by users.
Caplo offers the following paid options through the Apple App Store: (a) Caplo Pro, a monthly subscription at $3.99/month providing 600 minutes of transcription per month; (b) Credit Packs, one-time purchases that provide additional transcription minutes which do not expire. All payments are processed by Apple and are subject to Apple's terms and conditions. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your App Store account settings. Refunds are handled according to Apple's refund policy.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Sparklight AI does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Transcription and translation results are generated by automated speech recognition and machine translation systems and may contain inaccuracies. You acknowledge that the Service should not be relied upon for critical, legal, medical, or safety-sensitive applications.
To the fullest extent permitted by applicable law, Sparklight AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your access to or use of the Service. In no event shall our aggregate liability exceed the amount you paid for the Service in the twelve months preceding the claim.
We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service will immediately cease. Your locally stored data will remain on your device.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sparklight AI operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
